Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the CartGo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. Your continued use of CartGo after changes constitutes acceptance of the updated Terms.

2. Description of Service

CartGo is a mobile application that helps users:

• Track purchases made at Costco warehouse stores
• Monitor product prices for potential rebate opportunities
• Receive notifications when prices drop on previously purchased items
• Contribute to a community-powered price database

3. User Accounts

To use certain features of CartGo, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

4. Subscription and Payments

CartGo offers both free and premium subscription tiers:

• Free Tier: Basic features including browsing, searching, and price tag scanning
• Pro Subscription: Additional features including watchlist, rebate alerts, and push notifications

Subscriptions are billed through the App Store or Google Play. Subscription terms, pricing, and cancellation policies are governed by the respective platform's terms of service. Store policies may vary.

5. Acceptable Use

You agree not to:

• Submit false, misleading, or inaccurate price information
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Scrape, crawl, or harvest data from the App
• Use automated systems to access the App without permission
• Impersonate any person or entity

6. User-Generated Content

6.1 Price Data

By scanning receipts and price tags, you contribute price data to our community database. You agree that:

• You have the right to share this information
• The information is accurate to the best of your knowledge
• You grant CartGo a perpetual, royalty-free license to use anonymized price data

6.2 Community Content

CartGo's community features let members post comments, photos, and chat messages ("Community Content"). You are solely responsible for the Community Content you post. By posting, you confirm you have the right to share it and grant CartGo a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it to operate the community features — within the App and in CartGo's own service emails to members, such as the optional weekly digest. Where Community Content (for example, a product photo) is shown outside the community feed, we present it anonymously, with no member name attached.

6.3 Zero-Tolerance Policy

CartGo has zero tolerance for objectionable content and abusive behavior. You must not post, share, or transmit any Community Content that:

• Harasses, bullies, threatens, or personally attacks any person
• Contains hate speech or slurs targeting race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Is sexually explicit, obscene, or pornographic
• Discloses another person's private or personal information ("doxxing")
• Is spam, a scam, phishing, or unsolicited advertising
• Is violent, depicts or promotes illegal activity, or displays hateful symbols
• Infringes the intellectual-property or other rights of any party

6.4 Moderation & Enforcement

Community Content is filtered automatically (including by AI) and may be reviewed by our team. We provide in-app tools to report objectionable content and to block other users; reported content is reviewed and actioned, typically within 24 hours. We may, at our sole discretion and without prior notice, remove any Community Content and warn, temporarily mute, suspend, or permanently ban any user who violates these Terms or our in-app Community Guidelines. Serious or repeated violations may result in termination of your account under Section 10.

To report objectionable content or a concern, use the in-app report and block tools or email support@cartgo.app.

7. Disclaimer

CartGo is not affiliated with, endorsed by, or connected to any warehouse club or retailer.

The App is provided "as is" without warranties of any kind. We do not guarantee:

• The accuracy of price information (prices are crowdsourced and may contain errors)
• That you will receive a rebate (store policies may vary)
• Uninterrupted or error-free service
• That the App will meet your specific requirements

Always verify prices at the store before making rebate claims. CartGo is a convenience tool and does not guarantee rebate eligibility.

8. Limitation of Liability

To the maximum extent permitted by law, CartGo and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the App.

9. Intellectual Property

The CartGo name, logo, and all related content, features, and functionality are owned by Arisdy Limited and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

10. Termination

We may suspend or terminate your access to CartGo at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination will survive.

11. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New Zealand.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
